American Judicial System

The American judiciary system was found on the adversarial model. In the United State of America, the constitution founders believed that the only best form of government was one that would promote the welfare of an individual such as one social class or a director. The middle class was favored as the most likely group to promote the common welfare because they had in mind that the rich and poor would mostly be concerned with promotion of their own interests. The founders of constitution also believed that the common welfare meant having total protection to each individual’s natural rights of property, life and liberty. They chose a form of government called the republican government (Vaughan, 2003, p. 1712-1862). Because England’s powers of government were balanced and divided among the king and the parliaments two houses (the commons and the House of Lords), this system was applicable. This is because it best exemplified republican government. Madison J. who was one of the United States Farmers had his own definition to the republic as a nation or country whose laws and policies are made and administered by some of representatives of the people. He recommended that those representatives should be elected by a large number of people but not a small class. In addition, he figured out that such a government would fully serve the society with no special consideration to particular groups. More so, apart from their nations of republican government, natural rights and common good the constitution founders wanted written laws that would clearly show the rights of all individuals and extent of the power in government. The American constitution sets forth the fundamental laws and rules showing how their government is operated and organized.Although most of the countries have both unwritten and written constitutions, the limited powers of the government by a constitution which must be obeyed by the government is the one that distinguishes a dictatorial gove rnment from a constitutional one. The contrast is perceived in that, the dictatorial government has unlimited powers over the government and its natural resources. It is very difficult for the citizens to force such kind of tyrannical rules to obey the law because the rules also control the nation’s defense force group like police and military.https://www. netsafa. navy. mil/ipg/judicial-process. htm In a government governed by a constitution, the laws set should show the basic rights of its citizens to their property, liberty and life. It states that the government should have a responsibility to guard such rights. It also has the government’s power limitations shows the extent to which citizen’s lives cannot be interfered with by the government. Also it includes the ways by which the nation can be changed through the consent of its citizens. The constitution farmers in America borrowed some ideas from the British model and came up with a series of balances and checks so as to have protection against power abuse by the government. To avoid domination of powers by one sector in the government, powers are given to quite different branches of government. The two main power branches in a constitution include; the executive branch which has the responsibility of enforcing the laws, and the legislative branch which is responsible for law making. This information centers on the judicial branch system in the United States government (Young, 54).Although all other nations have laws and rules governing people’s relationships with each other, and other kinds of rules which govern human relationships like the custom, religion and accepted morality, the American’s judicial system appears to be a bit complex. The complexity is with the courts at different levels like in state, Federal County and Municipal bodies. It is not easy to understand the interrelationships although there are laws which clarifies jurisdiction and assigns responsibil ities. According to the judicial foundation system, nobody and nothing in the country can stand outside the law or above the law.In the United States, the penalty for running a red light in vehicles is same to the general or admiral because it is made for a season or private. The brief in the primacy of the law is basic to the citizen’s way of life. The law becomes the ultimate arbiter while the courts are its major guardians. The actions of all other government branches must have consistency with the laws. With regardless of citizens’ official status, social position, religion, wealth or political creed, they are all subject to the law. This acts as one major goal for justice in America. The court ensures same law enforcement upon the powerless and the powerful. Due to this reason the courts and the law are said to be the fundamental guardians of equality life in United States. What is more important with American Judicial system is that, once an individual is accused of crime, he or she is regarded as to be innocent until when he is proved guilty in the courtroom. This implies that, the burden of proof is left to the prosecutor, the accused victim requires not prove his or her innocence (Young, 54). Once a person has been accused in law violation, the law insists that such an individual be tried by a jury. These juries are made up of just ordinary citizens who are chosen to serve temporarily in court to listen to the evidences in case where by they decide whether the accused is innocent or guilty. They are not official government. In United States, judiciary is a quite separate branch of government. Besides the fact that judicial system is subject to the same types of balances and checks as for the case in legislative and executive branches, it is not controlled by either of them it implies that, courts are not in any way influenced by the executive and legislative in their duties.Their courts are perceived to play an important role in their acti vities to shape the public policy. They are seen to provide judicial legal interpretations for both civil law and criminal law. More so, they shape legal policy through appeals and trials (Harper 1998). After adoption of the constitution in 1989, the federal and state courts have used the power in declaring an action at the executive branch or legislature as unconstitutional thus making them null and void. Generally, the American courts are no only important because of justice administration but also due to shaping public policy.According to many people it is perceived that American justice is very slow. Yes it is true that the dockets of court are very full but all these aims at fairness in justice. The judicial system of America is an integral system where by the people’s rights are protected against government interferences. Due to judicial system body being set as an independent body, it is true that justice is being administered in light of the court room work groups and assembly line justice.According to the citizens, this is a very good thing because there is no difference between poor and rich in the law administration. Concrete Experience Essay

As an engineer of a pharmaceutical company, I directly report to my supervisor on a daily basis. I am very diligent with my work and I see to it that I perform at my best. I followed the orders of my supervisor and I work hard to meet deadlines. However, there is always a point in time where I realized the lack of efforts in the part of my supervisor. Sometimes, it has become a routine basis to be given a task, work on it, finished it with expected quality then reports to the supervisor on the job done. I sometimes ask, where his effort sets in the picture does, I have nothing against him personally, but having to question such setup can be regarded as my simple dilemma. It is very true that a working relationship among employees and supervisors, there will always be disputes or misunderstandings among them. Such causes of conflicts can come mostly from the side of the supervisor, such as failing to set clear expectations or to reinforce them regularly, letting the problems which they are aware of fester before having to address them, failure to communicate with people with problems, failure to recognize the importance of due process, taking some matters personally, or moving too quickly toward formal action, having to discriminate difficult or troublesome people, having to wait too long before getting professional help, being unwilling to see s resolution forma problem, worrying too much or reflective organization. These can be too general, but the happening of any of those critical causes may lead to serious working relationship problems, so before getting any matter to its worst, one of the parties can take the initiative to patch things up, or to start discussing with each other in order for compromise to take place. Reflective Observation It never occurred to me that this person was doing something different than I was and, as a result, had a better relationship with the supervisor.   And it certainly never occurred to me to ask him what he did to have such a great rapport with the group.   But both parties had stereotyped the other and were unwilling to change their opinions. Since other people and groups managed to have good relations with others, we could hardly be justified in thinking that they were totally in the wrong. This supervisor was more focused upon tasks than people so they never worried about the personal cost of the conflict, and probably did not know how to resolve the problem. Even though the supervisor knew about the problem, they did not intervene, perhaps because the work always got done somehow.   (Schein, 1996) Abstract Conceptualization Conflict can be regarded, abstractly, as neither wrong nor right and bad nor good. The meaning of conflict is recognized by its participants given that people who add value on its meaning. The vital results of a situation of conflict are dogged by the beliefs, values and feelings, of those who are involved. The real determinants are the people of the meaning of conflict. As humans though, and it is almost impossible for us to divorce ourselves of feelings, beliefs, and values. People create, or get involved in, conflict, and all possess predispositions as to how it ought to be addressed or handled. There is the tendency to have a strong behavioral leaning, a set pattern, for participation, and this emerges as a major factor in setting the nature of conflict. (Peppers, 1976) Active Experimentation   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   If I do not have control over other people but if I act appropriately, I will have a much better chance of getting the cooperation I desire.   What is positive about having negative experiences is that hopefully I learn from them.   If sincerely worked with him and combined my weaknesses with his strengths and vice versa, I am sure that we would have been able to come up with better ideas, solutions, and programs that would have helped our company more. Another concept I must use in the future is how to combine different personalities in order to solve or create concepts or ideas that would be superior compared to those created only by a single personality type. For example, the production manager and I had extreme personalities. My mistake was that I am focusing on my strengths and perceived our differences as his weaknesses. In every way we try to put it, the result of conflict is probable to be dysfunctional. The decision of doing nothing is probably not the best. On the other hand, the supervisor involved must make have the determination. This can only be a decision function of the contingencies of the situation, a decision which can only be made by someone in the situation evaluating the forces and strengths involved. A unique method to resolve conflict is to increase interaction between conflicting groups by physically exchanging persons between conflicting groups.   The result should be better communications, greater understanding, and less future conflict. The supervisor must understand that there are times when the decision to do nothing may be best. (Peppers, 1976)   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   The issue can also be solved through mediation, if ever the situation gets worst. Basically mediation is a confidential and a private process to resolve conflict, it can deliver the opportunity to better understand and recognize the perspectives of others and at the same time be able to develop skills in communication that can contribute to the ability of further undertaking issues related in the workplace. Such process can help people the within the organization to have clarity on matters which can be vague to some. Mediation can be very challenging, because both parties involved should bring up together their different point of views. Each party should have an open mind and the willingness to listen. The success of mediation will lead to building a new relationship which is for the good of all those involved. (Hall, 2001) Concrete Experience   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Way back in college, I have been an organization president; I was elected to lead my academic organization in all the internal and external activities. Being titled as the president may be elevating; it somehow gave me a boost in confidence and there is the fact that there are people who will be working under me, I have the authority to delegate tasks, and approve or reject new ideas. But being the president was not just having authority and the privilege to man how everything works in the organization, when it come to problems or difficulties, I am the one expected to arrive at a resolution. I am the first point person on everything that the organization does; therefore I am accountable in everything especially when we are encountering a lot of difficulties. One of the major challenges that I have to face was getting my organization as one; there comes a point where my co-officers seem to be unmotivated. They do not have the same level of perseverance or drive that I have. They do what I say, but they are lacking enthusiasm and eagerness to do specific tasks. This was hard for me because I do not want to be demanding, but their passiveness provokes me to be a little hard to them. I usually think if only I am a superhero, then I would do the entire job and not ask help from them, but reality is, I am just a leader who needed the help of my co-leaders. There was a certain point where I had been tired to act, but the sense of accountability pushed me to initiate and had my organization driven in order to perform at our very best. Reflective Observation   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Having to face such issue made me realized that I am different from them, and that I should not expect everyone to treat things the way I treat them. I may be motivated, but it is natural for some to be unmotivated. During my organization days, I have been joggling my time in order to still do well in my studies and be a responsible leader at the same time. It was hard, and I realized that my co-officers might have been experiencing the same dilemma; the only difference is that we have the different characters on how we deal with those. I have been struggling to get them all together and encourage them to speak out, then I realized that as the leader, I should have to act to have them motivated, to have them realized that I need, the organization needs them. Abstract Conceptualization The first resolution that came in my mind is motivation, comparing the organization in a business institution; there is a similarity of motivation issues in terms of co-officers and employees. A combination of energy and desire bound at fulfillment of a goal is a person’s motivation. In order to influence someone’s motivation calls to getting them to do what a leader know what needs to be done. According to the theory of motivation of Frederick Herzberg, there are various factors are involved to be able to instill motivation to the employees. Those factors may work as anticipated but may also fail because to resistance. (Herzberg, 1968) First are the KITA (â€Å"kick-in-the-ass†) factors, which are also connected with hygiene factors, such are extrinsic to the job. It consisted of administration, company policy, working environment or setting, security, supervision, compensation, and relationships with others. Meanwhile, the factors of motivation are job intrinsic, which comprised of the task itself, having achievement recognized, growth or advancement and conscientiousness. These factors are all interrelated with job dissatisfaction and job satisfaction. According to studies, the primary source of satisfaction is the motivators while what cause unhappiness in the job are the hygiene factors. (Herzberg, 1968) Having motivated co-leaders is a great aspect for an organization to be successful. Motivation compels them to act upon, do extremely well and give their 100 % percent. Active Experimentation Given that I am responsible for my organization, then I should have the initiative to set one foot forward, knowing that the issue is stemmed out from motivation, lack of motivation to be specific, then I must resort to ways on how to get my co-officers to be driven and motivated to carry out their tasks and duties, and that is what I did. Basically, I allowed the needs of my team to coincide with the needs of our organization. Rewarding is also an effective resort (Craig, 1996), simple acknowledgement to a job well done has boost their spirits and at the same time helping those who make mistakes or may need occasional help in order to achieve a specific goal. Another important thing is to set a good example, in my part, I have to stay motivated, I have to present an image of how a leader should be. Developing moral and team spirit is also very important. As a leader, I look out for my team, although I do not have control over their lives I should see to it that I empathize with them.   It is vary significant to allow them to be part of the planning and the processes in problem solving for this will help them develop, this will motivate them and will give them the interest in seeing a plan succeed, thus keeping them well informed is also important. Moreover is the importance of communication, leaders should see to it that a communication channel should always be open in order for everything to flow smoothly within the organization. It is also very vital to make each feel like an individual in a great team instead of a component in a lifeless machine. People call for evocative work, even if it is unpleasant and tiring; they need to be aware that it is necessary and important for the continued existence of the organization, (U.S. Army Handbook, 1973) hence there should be room for counseling wherein the members can voice out their opinions and where the leader listens and vice versa through which, the leaders and the subordinates can keep track with each other. Concrete Experience We are all working hard and striving for success, and in the courses of our careers, the fear of failure serves as pressure as we perform our work. Failure seems to be the dirtiest word in the society, I as an individual who works hard to be successful fears failure, I would rather be seen as hostile, overworked, odd rather than be seen as a failure. I think it is natural to have the fear of failure as we place tremendous stress on success. I think the fear of failure is probably the strongest power that holds us below our potentials. In our world, misfortunes can really happen this is why; I rather play safe most of the time. However, playing safe is a form of risk as well. Whenever I fail, I feel extremely bad, I felt that I am stubborn enough that I failed, maybe that is reason why I also developed my fear of failure. Because of such fear, our merit and ability are often underestimated, we then find it hard to recover and accept failure and some valuable opportunities are passed out. Reflective Observation Success and growing from it is not an easy experience. We can really get knocked as we persevere to succeed in our careers. The biggest drawback I have to deal with is fear of failure and I know that it can lead to terrible outcomes. What the fear of failure does is form an approach in opportunity which is overcautious. Being aware of when and how to make use of opportunity is essential to a successful career. Possessing understanding about the opportunity, I then need to find out timing. The pros and cons listed will help in making a decision. Fear of failure can also keep us from speaking up. It will cause us such hindrance to remain in silence and foregone the chance to stand out. Another major impact of this fear is missing out the point of professional and personal growth. If we really want to be successful, we should be prepared and grow with it. I know I should loses this fear of failure and be able to risk something which is important, in the long way ahead, I know I will be glad that I did. Abstract Conceptualization We can face the fear of failure by having an understanding of constructivism which is child-centered; it suggests that the environment of learning must shore up numerous perspectives or reality interpretations, construction of knowledge, richness of context, activities based experience. Constructivism concentrates on knowledge construction, and not on the knowledge reproduction. It is a conviction that from one’s experiences, mental structures, and beliefs that are used to interpret objects and events one constructs knowledge. The mind is influential and indispensable in understanding perspectives, events and objects on the basis that is individualistic and personal. Our outlook of the external world varies from others for the reason that we have our out set of unique experiences. (Dweck, 1999) Learning is influenced by the learner’s prior knowledge, learning goals and personality therefore it is an internal process. Constructivism illustrates the environment of the wherein knowledge and the creation of knowledge is inductive, collaborative and interactive, wherein manifold of perspectives are corresponded to, and where questions are appreciated (Goleman, 1997). The significance of context associated to learning and knowledge and â€Å"authentic activity† are given important emphasis. Active Experimentation Having the fear of failure should not be disregarded, it should be acted upon the soonest time possible, because having to endure such will make us stagnant and afraid to go beyond the norms, we will be stuck under the state of mediocrity, which we know is not good. The fear of failure had me bothered, but I told to myself that I should not lose in my game with it, I should overcome it. In order for me to lose my fear, I started thinking and considering the cost of missed opportunities if I pass on to them. Many careers out there entail a broad variety of opportunities therefore when opportunities came, I should be able to try my chances. I know that taking risk is very important and a greater reward is at stake. The issue of the fear of failure here is that without taking risks we cannot exploit opportunities. We can opt to live a rather simple, happy and peaceful life but we will be hindered to do something new and we then cannot make a difference in our world. The source of this fear is unknown I realized that when we do not know what are we dealing, the possible consequences can get worse. The fear should be understood, we should then have a holistic understanding of failure, its risks and benefits, by means of an analysis, and I can then get through my fear and further make a decision. It is also ideal to always put ourselves in the perspective of the worst-scenario. Making a plan of contingency is also a good strategy in order to reduce the downside and overcome the fear of failure. I should then manage the risk well and create a contingency plan so that I will be able to have a backup plan if ever the chances of failing are very high. An understanding of the benefits of failure also helps as each failure is like a trial in an experiment and an opportunity to growth, even if it can costs us a lot, there is an assurance that the benefits can outweigh the loss. (Jackson, 1993) Each failure is a trial in an experiment and an opportunity for growth. Even if a failure costs you financially, the educational benefits can far outweigh the loss. As I am determined to overcome this fear, taking action is the best way to start, though which I am certain to have a boost in confidence. I know everything is hard on the start, but it may be possible that with taking small steps, I can then build up my confidence and be able to manage the fear of failure. If there is a goal, but is afraid to commit, we should then force ourselves, the fear of failure disappears when we realize that it cannot save us. References    Applewhite, P. Qar Reading Strategy

Grade Level(s)| K-3| When? | Literary Focus| Before| Fluency| During| Comprehension| After| Vocabulary| | Writing| | Oral Language| Q. A. R. (Question-Answer-Relationships) Question-Answer Relationships, or QAR, is a reading comprehension strategy developed to aid in the approach that students take when reading texts and answering questions about that text. Students learn to categorize types of questions which in turn help them know where to find information. It encourages students to be active, strategic readers of texts. QAR  outlines  where information can be found â€Å"In the Text† or â€Å"In my Head. It then breaks down the actual question-answer relationships into four types: Right There, Think and Search, Author and Me, and On My Own. (Fisher, D. , Brozo, W. G. , Frey, N. , & Ivey, G, 2011, pg. 81) STEP-BY-STEP and EXAMPLE Chosen text: Frog and Toad Together, by Arnold Lobel 1. Hook/Engagement–Begin by reviewing what students have already learned about how to ask questions as a way to understand the meaning of texts. For example using this reading asks them to talk about the kinds of questions they can ask before, during, and after reading. Next, introduce the idea that there are two kinds of questions you can ask about texts.Explain to students that an â€Å"In the Text† question is a question that students can find the answer to by looking in the book that they are reading. An â€Å"In My Head† question is a question that requires students to think about what their own knowledge is to answer the question. Review a book that you have recently read aloud with students. Write the example below on a piece of chart paper or on the blackboard. Choose a few â€Å"In the Text† and â€Å"In My Head† questions about the book that obviously belong to one category or the other, and have students tell you in which column to write the question. When you give students a literal question, have them show you where they fo und the answer in the book. When you ask them an â€Å"In My Head† question, go through the book with them and show them that they couldn't find the answer in the book. Have them give answers to the â€Å"In My Head† questions and explain how they answered them ( thinking about what they have learned that is not in the book). Here are some examples of the two types: â€Å"In the Text† questions| â€Å"In my Head† questions| What is the title of the book? What is the author's name? How long is the book? | Do I like the title? Have I read any other books by this author? How long will it take me to read this book? | Explain that they are going to learn more and ask these types of questions about a new book you are going to read together. 2. Measurable Objectives–Explain that you are going to read the first three chapters of Frog and Toad Together aloud to them, and they are going to help you make a list of â€Å"In the Text† and â€Å"In My Hea d† questions. Then, they are going to help you answer the questions and see how these types of questions will help them to understand the story. 3. Focused Instruction–Review with students the four types of questions explained in the QAR Strategy.Explain that there are two types of â€Å"In the Text† questions and two types of â€Å"In My Head† questions. Draw a copy of the QAR table on chart paper or on the blackboard or use an overhead projector. The table should look something like this: â€Å"In the Text† questions| â€Å"In My Head† questions| Right There| Think and Search| Author and Me| On my Own| Read the first chapter, â€Å"A List,† from Frog and Toad Together aloud to students. Next, write the questions listed below under the â€Å"Right There† heading. Read the questions aloud, look through the chapter, show the students where you found the answer, and then think aloud the answer. . Right There i. What is the first t hing Toad writes on his list? â€Å"When I turn to page 4, I see that the first thing Toad writes on his list is ‘Wake up. ‘† ii. Who is the friend Toad goes to see? â€Å"When I turn to page 9, I see that Toad goes to see Frog. † Next, write these questions under the â€Å"Think and Search† heading. Read the questions aloud and then think aloud the answers. b. Think and Search iii. What caused Toad to forget what was on his list? â€Å"I read that Toad's list blew away and Frog did not catch it, so that is why Toad couldn't remember what was on his list. iv. How did Toad finally remember what was the last thing on his list was? â€Å"Frog reminded Toad that it was getting dark and they should be going to sleep – the last thing on Toad's list. † Next, write these questions under the â€Å"Author and Me† heading. Read the questions aloud and then think aloud the answers. c. Author and Me v. What do you think of Toad's list? †Å"I think that writing a list of things to do is a good idea. But, Toad could have left off some things, like waking up or getting dressed, because he doesn't need to be reminded to do that. † vi.Did you agree with the reason Toad gives for not chasing after his list? â€Å"No. I think that he should have chased after his list, even if it that wasn't one of the things on his list. He couldn't have written that on his list anyway because he didn't know the list would blow away. † Next, write these questions under the â€Å"On My Own† heading. Read the questions aloud and then think aloud the answers. d. On My Own vii. Have you or somebody in your family even written a list of things to do? â€Å"Yes. I have written a list of things that I have to do on a weekend day because that is not like a school day.On weekends, I do lots of different things, so I have to write a list to remind myself of all the things I have to do. † viii. What would you do if you lost your to-do list and couldn't find it? â€Å"I would look for it for a while and if I couldn't find it, I'd write a new list of things to do. † 4. This would be followed up with guided practice, independent practice, assessment, and the reflecting/planning. References Fisher, D. , Brozo, W. G. , Frey, N. , & Ivey, Gay. FEX_HUM310 Essay Example | Topics and Well Written Essays - 1000 words

FEX_HUM310 - Essay Example It is very democratic because having a book about how to become important levels the playing field. This article was important because at the time, everybody thought a Catholic president would basically just do whatever the Pope said without thinking of America first. However, Smiths article argues that this belief was completely against Americas constitution, which allowed for both freedom of religion and the separation of church and state. It influenced American values by drawing peoples attention again to the basic rights set out by the constitution with regards to religious rights. On the Road, like other books and poems published during the Beat Generation, was a book that really called into question the traditional values of America. It represented a big shift in the way people thought about things, and was very liberal or even radical. Once people accepted it America began to accept more liberal ideas. The Feminine Mystique is an important book because it drew attention to the way American women were still mostly a subservient gender. They were unhappy, but because for them to be happy might call into question traditional values about what women were supposed to do in the home, not many people wanted to know about their unhappiness at first. Friedans book brought this problem to the national attention. Martin Luther King Jr. wrote the letter in response to criticism of his protests in Birmingham Alabama. He claimed that unjust laws should be disobeyed because of morals. It is a significant document because it suggests that America was not as good at giving everybody an equal, democratic chance as it wished to believe. It also sets forth an alternative way for the oppressed people like African-Americans to change their country for the better. Bellow was controversial because of his conservative social and political views. He made statements and

Salsa as a Dance Essay Example | Topics and Well Written Essays - 1000 words

Salsa as a Dance - Essay Example With room for both partners to strut their stuff, this method of dance is becoming increasingly popular throughout dance institutions and afternoon school programs not only across the United States but also the most of the other parts of the globe like India etc. Salsa dancing works with a kind of music which is basically designed with two bars consisting of four steps. Salsa dance is eventually designed for a world where leg and arm work with mesmerizing body movements give rise to passionate emotions and at the same time tend to be equally romantic. Salsa dance is actually a partner dance which is usually danced to salsa music. "The history of the Latin popular music known worldwide as "salsa" began centuries ago in the islands of the Spanish Caribbean, in a context of slavery and colonialism. Yet, it is inextricably tied to twentieth-century New York City and the growth of a thriving Latino community here. Its distinctive polyrhythm and vocal and instrumental call-and-response identify the Afro-Caribbean roots of Latin music -traditional and contemporary, sacred and secular (Salsaweb.com)". "Over the years, the sounds of salsa and the steps of the dance migrated to the U.S. as early as the 40s, where further cultivation took place in the New York City Latin population during the 1960 and 70s. Cuban and Puerto Rican communities throughout Latin America and the United States are responsible for shaping most of the steps we see today. The culture surrounding salsa also takes cues from the styles of mambo and rumba. The typical instruments accompanying salsa dance includes the thumping of congas, blaring trumpets, cowbells, timbales, and claves (Bachata Crazy.com)". Salsa dance is extremely simple and of course it is equally flexible in movements. Salsa dance is just like walking in any chosen direction and dancing on a particular spot both in straight lines or turning paces. "A step is when you put your foot down and moves your weight onto it, to be specific foot placement with weight transfer and a tap is when you put your foot down but don't move your weight onto it i.e. foot placement without weight. In many Latin countries, couples even choose which beat they would like to dance on, and it need not necessarily be the first beat (Yoe)". Both Salsa dance and music are actually believed to be originated for one another. The main purpose of existence of the renowned Salsa music has always been for dancing. "Its cooperative heritage has engendered a belief, in Latin America at least, that everyone else has an equal right to enjoyment on the dance floor (Yoe)". Both the Salsa music and dance have maintained their vitality by absorbing other influence over the decades. The dance of Salsa has got some similarities with actions like lindy - hop, hustle and swing. It has even proved capable of absorbing elements of ballroom Latin dance and Argentine tango. This fact itself sounds quite astounding to many of the lovers of Salsa. There is a lot of variation with the dancing of Salsa depending on the origin of the person dancing it along with the origin of the place from where the dance has been learnt from. At a basic level, salsa dancers from different origin can actually dance together. "British salsa is primarily anchored around the back basic; turns are executed on the second beat

Employer's Duty of Care and Issues of Compensation Research Paper

Employer's Duty of Care and Issues of Compensation - Research Paper Example This issue can be related to the case Hatton  vs.  Sutherland held in 1998, which involved a dispute concerning  compensation  of injuries at work place (Legal Information Institute, 2010). Jake’s  action  in  association  to his scope of employment Scope of  employment  is determined  by the role taken by an employee, which is in accordance with his/her employment contract. This will also  mean that an employer will  refer  to the contract to undertake any action concerning injuries suffered in work places. Jake’s scope of action in reference to his  employment  agreement entails that he should be responsible for checking brakes, tires, oil and transmissions in vehicles from the showroom. As per the employment scope, individual employees are to be compensated for any case of injury, which might occur while in a working station (Steingold, 2010). This is beneficial to the employer in case there is no possibility of employee delivering as per the scope of employment. This will mean that the  employer  will not  take  any responsibility actions  being undertaken  by the employee. Jake’s  role  is service delivery, and he  has been authorized  to  change  the oils in the vehicles regardless of the situations with the vehicles (US Legal, 2011). However, Jake decided to  service  the  whole  vehicle. ... It is for this  reason  that  I  reckon that Jake’s  action  is within his scope of employment. If Jake  had been hired  to change the oil only and not to  service  the vehicles, then he would have been acting out of his scope (Steingold, 2010). Herman’s responsibility for Jake’s injury Jake’s  injury  that occurred while at work is the responsibility of Herman. During the time of the injury, he was working within his scope of employment. Therefore, he  was injured  while he was on duty. That is why the employer should be responsible as stated in the scope of employment. This scope  is usually determined  under the doctrine of superiors, which states that the  employer  is  answerable  (Nolo Law for All, 2010). This  doctrine  also underlines that an employer should assume  responsibility  of the employee since he is  superior  and the employee works under him. That is the reason why the employer should b e  accountable  for any injury suffered by an employee during the time he/she is on duty at work. The employees  are also covered  under the insurance package of the organizations, which means their employers should compensate them in case of injuries at work. In this case, Jake is under the protection of State workers’ compensation laws. This ensures that employees  are compensated  for any injuries incurred during the working hours. This puts Herman into the  picture  as he  is supposed  to be liable to compensate the injury incurred by Jake (Nolo Law for All, 2010). Jake’s overtime  payment Jake is not eligible for overtime payment as he is among the management team in the company owned by Herman. This is because from their dialog we understand that he is on permanent payroll, compared to the

Richest man in Babylon report Assignment Example | Topics and Well Written Essays - 750 words

Richest man in Babylon report - Assignment Example Similarly, a passive income must be pursued with the same intent [of fattening the purse- not draining it]. In The Richest Man in Babylon, Bansir and Kobbi inquire from Arkad why they were less financially fortunate, while Arkad had managed to grow rich with time. Several concepts are issued by Arkad and serve as important gems of financial wisdom. One is that no one should live beyond his means. Saving money is the genesis of wealth creation. The second important aspect of making wealth is investing. Investing the money saved should allow the investor to accrue passive income. Finally, the investment must be done wisely. In the seventh chapter, The Seven Cures for a Lean Purse, the King of Babylon, Sargon of Akkad is told of the poverty of the kingdom by his Royal Chancellor. People are subsequently told to: save a tenth of their earnings; control their expenditures; multiply their gold; guard their treasure from loss; insure a future income; and increase their earning power. Seeing that only the sixth and seventh parts are the ones that have not been delved into, it is important to appreciate them as calling for a remembrance of the days in which one will never be able to work and increasing one’s education on investing. The more one knows, the better that person will be in investing, and the more money that person will make (Clason, 17-32). In The Luckiest Man in Babylon, Arkad’s small school has blossomed into the city’s Temple of Learning. What is learned from this chapter is that there has to be a preparation for profitable opportunities, instead of waiting for luck, since luck cannot be stimulated to occur repeatedly. Procrastination in action and through indecision is also a bad practice. In The Five Laws of Gold, Kalabab asks what one would choose if offered a bag of gold or tablets whereupon are curved words of wisdom. The laws teach that: saving a fraction of

The importance of sex education Essay Example | Topics and Well Written Essays - 2750 words

The importance of sex education - Essay Example Sex, apart from the education perspective is akin to hunger and thirst in many ways. However the need for sex is not that powerful as that of food and water. Just like food has its own importance in our daily lives which influences our social, cultural and moral values but also highlights our economic sustainable conditions, same as the case with ‘sexual values’ where it seems that for sexual behavior, environmental factors are more influential than psychological factors. Simon and Gagnon (1986) describe environmental factors in terms of sexual(Strongman, 2001, p. 16)The importance of sex education in the context of learning can be considered just like other subjects on the curriculum: it involves the transmission of information; it contributes to the development of personal autonomy;and it seeks to promote the interests of both the individual and the broader society. (Halstead & Reiss, 2003, p. 3) In other respects, however, sex education is quite different. It is about human relationships and therefore includes a central moral dimension. It is about the private, intimate life of the learner and is intended to contribute to his or her personal development and sense of well-being or fulfillment. It generally involves intense emotions, to do not only with intimacy, pleasure and affection but often also with anxiety, guilt and embarrassment. In all of these respects, values are involved which need to be researched and studied for the self-consciousness of younger generation.

Los Lobos (Musical Band of Los Angeles) Essay Example | Topics and Well Written Essays - 1000 words

Los Lobos (Musical Band of Los Angeles) - Essay Example It is their similar interest in music of the same genre and musical acts like the Fairport Convention, which perpetrated their working together musically; therefore building their musical career as a band. The two visited one another in their homes occasionally, where they listened to various music recordings, playing guitar; especially for David, who was very good at it and later on even started writing their songs. It was not very easy for them to work on their music regularly as they both had regular jobs to attend to and most of the time therefore had to work during odd hours; especially at night in order to make up for the time spent at work. David and Perez also did much of borrowing of music recordings from a friend, which were of the parody and free form jazz. It is through these many recordings borrowed that the two made a collection out of it, creating multi-track recordings. To form a complete band that they had wished for, they decided to recruit some of their classmates who are Cesar and Conrad; that was in the year 1973. Their coming together to form a band had them record an album that was titled, ‘How Will the Wolf Survive? that gave them a lot of praises and made them very popular in Los Angeles. They later released La Bamba in 1987 that created even more opportunities for them musically, due to the added praise and popularity that the band received. Since then, the band has never disappointed their music fans in Los Angeles and across the world with their rock and Latin music. Despite all the challenges that Musical bands are faced with in each passing day, Los Lobos have managed to overcome all these challenges by recording over 20 albums in approximately 3 decades and making sure to reach their fans with total satisfaction. However, their ride in the music industry was not as smooth as any other person would think. The sale of their music videos was a bit lower in the beginning and therefore

Knowledge Management Foundations of IT Systems SLP Research Paper

Knowledge Management Foundations of IT Systems SLP - Research Paper Example SAP stands for Systems, Applications and Products in Data Processing and was founded in 1972 and it is the biggest provider of business applications. The applications offered by SAP crystal solutions are used by organizations and businesses in analysing, interpreting and presenting information. The process of creating new information in organizations is made easy by using the applications offered by SAP solutions. Bogorad (2010) states that data are discrete facts about objects and events which are necessary in the business system but have little significance on their own. There is need for the data to be interpreted and analysed and the SAP tools can be used in organizing the data to enable easier analysis and interpretation. After the data is organized with a specific purpose in mind it becomes information and this is used to make decisions. The SAP tools organize data into useful information. The SAP crystal reports software is an application that is used to design reports which a re interactive and connects them to virtually any data type (SAP crystal reports, para.1).This is a useful tool as it can help the employees to recognise patterns and be able to make accurate decisions based on accurate predictions from the reports.

Personal Computer and Dell Essay Example for Free

Personal Computer and Dell Essay Synopsis: In 1984 Dell Inc. was founded by University of Texas freshmen, Michael Dell. Dell would buy computers from the excess inventory of local retailers and revamp them to sell out of his trunk. Dell was able to sell his computers at 10%-15% below retail price. After Dell’s freshmen year he dropped out to run his business full time. By 1995 Dell had sales of nearly $3. 5 billion and was one of the top five PC vendors in the world. Dell focused on customer support and service and became the master of process engineering and supply chain management. Dell has faced many challenges including distribution through US retail stores, management changes, and keeping up with its competitors. Since consumers aren’t willing to pay huge amounts of money for computers unless they were unique, Dell is at a crossroads. Which road Dell chooses to follow will determine its future. Resources: Dell Inc. ’s most valuable resource has been Michael Dell and its ability to sell computers at 10-15% below market value. Another huge resource is the executive team that Dell formed for guidance. Capabilities: Dell’s capability at producing products at a lower cost to its consumers is key. By adding services such as laptops, software/peripherals, servers/networking, services, and storage Dell expanded its capabilities. With the added services Dell can keep pace with its competitors. Core Competencies: Dell’s core competencies are the ability to offer quality products at cheaper prices, personalized orders, and the ability to keep their inventory relatively low. These competencies have helped Dell become a leader in the computer industry. Finding of Fact: Dell is currently at a crossroads; the company’s margins aren’t in a favorable position for the company. In 2010 yes their net income rose, but was still only 2. 91% of net revenue. Dell’s consumers are no longer willing to pay top dollar for a computer, unless it was unique. Competitors are selling laptops for around $300. Tablets have pushed Dell’s laptop sales down as well. Many more competitors have stepped into the industry since Dell first was founded. Dell also spends about 1% of its sales on research and development, while other companies spend about 5%. Justified Recommendation: Dell should invest more of its money into research and development for its products. Technology is constantly changing and for Dell to stay ahead or at least at the same pace, research and development is a must. I’m not saying Dell needs to go out and hire some new employees for this team. Dell could use members from each of its sections to help brainstorm and come up with new and innovative ideas. Innovative employees are invaluable to a company. Dell’s management should perform environmental scanning both internally and externally to find Dells SWOT (strengths, weaknesses, opportunities, threats). Once SWOT is determined management could strategically figure out how to move forward. Environmental scanning shouldn’t be done just when a company finds it has â€Å"hit a bump in the road†, but periodically to keep the company innovative and make sure it is on the correct path. Dell should also perform an industry analysis. This analysis will review potential entrants, buyers, substitutes, suppliers, other stakeholders, and competitors. By completing the analysis a company can determine the high and low forces against the company. The low forces could be turned into a possible opportunity or based on the analysis results, the company could switch strategies.

Customer Care And Complaint Resolution Policies Commerce Essay At Romans Pizza, According to Chenet and Johansen (2006) customer care is the ability to inspire trust by being courteous, knowing ones products and understanding the customers needs. Complaint Resolution Policies are defined as To see the analysis of customer care and complaint resolution policies at Romans Pizza, this project consists of five chapters. However a s researchers we will also recommend to the management in terms of how they can improve on customer service considering that this is a more competitive and even globalized world .this research work shall be handed over to management. CHAPTER 1 THE FIRM Researchers used Romans Pizza Time Beaters (Pvt) Ltd as a case study and conducted a research based on an Analysis of Customer Care and Complaint resolution Policies. This firm was found in 1993 when Arthur Nicolakakis bought over a struggling Pizzeria. He had a vision to provide the best quality product at the lowest price. Its goal today is still to be the best value for money in the industry. Here in Botswana its operations started in September 2010, opening a single outlet in Gaborone which is located at Game City mall. It is said to be opening other operations in Francistown-Blue Jacket Street, Phakalane, and Square Mart Mall. The competition in this industry is very tough as new entrants enter in succession. PRODUCTS It is producing and selling pizzas. They range from sizes small, medium and large. A customer can either book for a pizza over the phone or in person, and it takes about 10 minutes for it to be ready. Various pizzas are produced with different flavours and taste depending on the ingredients used by the production department at Romans Pizza Time Beaters (Pvt) Ltd. They also sell beverages such as water and soft drinks. THE INDUSRTY Romans Pizza Time Beaters (Pvt) Ltd falls under hotel catering industry. Its competitors include Debonairs Pizza, other restaurants who are selling the same products and Pizza Den. Romans Pizza Time Beaters (Pty) Ltd has also branches in South Africa. Time Beaters (Pvt) Ltd was incorporated in 2010 to provide timely and precise transportation to product providers. CHAPTER 2 CUSTOMER CARE POLICY AND VISION Customer care policy refers to the guide lines that are adhered by the organization when it is dealing with the customers whenever there is a problem. Usually such issues are expressed in vision and mission of the company in relation to the customers. MISSION Mission refers to what an organization aim for its purpose and existence as a supplier or producer of goods and provider of a service to the organization, (Schermerhorn, 2008). Romans Pizza Time Beaters (Pvt) Ltd mission is The Pledge Every Romans Pizza meal is made from the finest imported ingredients, all the way from Greece and Italy, as well as the freshest local ingredients. All meals are prepared to order and are therefore guaranteed to be fresh, delicious and straight from t he oven. The staffs ensure that the pizza experience is truly fit for a king. These are pizza perfectionists, it with and can prove it with the proud and passionate price promotion. Vision refers to the future predictions of the business in relation to what it offers in terms of services that it offer, (Schermerhorn, 2008). Romans Pizzas vision is to be one of the best in selling pizza and to provide customers with the best value and to provide the best quality product at the lowest price. Its goal today is still to be the best value for money in the industry. IMPACTS OF THE MISSION ON CUSTOMERS This mission has a very big effect on customers as what comes into their mind immediately they see the mission statements. They will opt to buy at Romans Pizza because most customers like to be associated with value and quality. So if Romans Pizza does not live up with the expectation of the customers that may work against their success of the business and mission. CHAPTER 3 FREQUENTLY FACED COMPLAINTS Definition of a complaint According to Chenet and Johansen (2006) a complaint is a chance of introspecting what could have been gone wrong and caused dissatisfaction. It can also be referred to as an expression of any dissatisfaction. Ways of logging in the complaints Customers who are willing to complain can pose their complaints via the companys telephone number The company also has a suggestion box displayed on the counter. What management do they will summon all the staff and brief them about the complaints raised by customers and coming up with a solution. The other mode of complaining by customers is through face-to-face. This includes face to face interaction between the customer, and a customer service representative of romans pizza, and then the matter is solved in the floor. The customers are supposed to report their complaints to the sales representative before reaching the manager. Process of logging in the complaints Customers have a way or process of complaining that is arranged by management of Romans Pizza. First of all, complaining customers raise their complaints to the sales representative. The sales representative can resolve the matter at hand if it does not require the top management. If the sales representative is failing to solve the matter, it is then directed directly to the manager. At Romans Pizza complaint numbers are not issued as complaints which are raised by customers are very average and minimal and they do not take long to solve a complaint so this avoid keeping customers waiting. Commonly raised complaints from customers Some of the complaints which are frequently by customers are as follows; Waiting period Sometimes customers say they take a very long time waiting for the pizza to be ready. Some customers order hot pizzas and want them right away but according to the Production manager, a single pizza takes about 10 minutes to be well cooked. Hygiene The level of hygiene at Romans Pizza does not impress some customers because one of the customers stated that it is not clean since there are always flies in the eating area, and the producers or cooks do not put on their hats properly thus chances of their hair falling in the food are very high. Wrong orders Another complaint that is raised is a mismatch of the product that customers have ordered. For instance, a customer might order a pizza in thick flavour and the seller can probably give the customer a thin base. This is usually due to many customers buying at the same time. The number of complaints that management of Romans pizza handle in a day cannot be measured as sometimes there are no complaints at all. In some days, one-two or three complaints can be raised and most of the time there are no complaints raised, they are very average in terms of number. CHAPTER 4 THE RESOLUTION PROCESS THE COMPLAINT RESOLUTION PROCESS (LIST) Complaint resolution processes are the steps which are used by management of a business by way A company can use the `LIST` method of solving a raised complaint by a customer. What happens is that when a customer is dissatisfied with any service pertaining a company in which he or she interacted he will be listened to. After a customer has complained and listened to the customer service provider will then isolate the core and associated problems by asking the complainer some questions. Then the service provider will then solve the problem as quickly as possible and by so doing the customer will be informed. The last step of this method is to take the feedback from the customer to ensure that he is satisfied. Researchers have discovered that Romans Pizza also use the same procedure while trying to solve complaints raised by customers. First of all management listen to a complaint raised by customers and look at where could have been the problem by asking the customer some questions that are related to the complaint. A service provider will make sort of a dialogue with the customer and if its a minor issue that can be solved by a service provider he will promptly solve it and if it requires the manager it will be passed on where he will settle the complaint. After all respond will be taken from the customer and will be informed. Usually each and every complaint is resolved using this same procedure. Escalation process Refers to Standard Turn around time Refers to time set to completing a process or an event that was done previously, (Kotelnikov, 2001). As different customers uses different means of logging in complaints so the turn around time also differs at Romans Pizza and depend on the type of complaints raised, but usually a complaint that is raised over the phone takes about 5 minutes to be solved and face-to-face complaint takes a very short time which is usually 2 minutes. Definition of Deviations Chenet and Johansen (2006) define deviations as a change from an agreement. As for the resolution process each and every customer is given the same priority and the process is the same while attending customers, even VIP customers. According to the customer service provider at Romans Pizza what the customer asks they provide in terms of services and said they appreciate customers complaints as they help in capitalising the mistakes done so as to work on it so that it can never repeat again. CHAPTER 5 THE REVIEW PROCESS ANALYSIS OF COMPLAINTS The staffs of Romans Pizza normally handle meetings every week after the complaints have been collected. They then try to come up with ideas as to how to solve those complaints and strategies to ensure customer satisfaction. They can make themselves better in giving the good customer service which makes them a good competitor against other rivals. HANDLING OF ESCALATIONS Romans Pizza normally make sure that those complaints that are frequently raised by the customers are known throughout the company so that those kinds of complaints can be prevented in the future. TURNAROUND TIME This refers to a set offered for completing a process or on event as done in the previous process or an event (Kotelnikov, 2001). The maximum time taken to resolve the customers complaint does not take more than 30 minutes. Time is considered as money at Romans Pizza the moment a complaint arise the customer care providers immediately takes action and if the complaint is not solved the manager is engaged to assist to solve the problem. This process does not take hour since the customer might lose patience and confidence in the company. COMPLAINT RESOLUTION CLOSURE At the end the branch manager of Romans Pizza should solve customers complaint fairly, that is to say the branch manager should be and give the customer compensation to ensure customer satisfaction and create a good image for the company. After the sale customer satisfaction is checked by calling back the customer to find out if they are satisfied with decision taken to solve the complaints. Conclusion To sum up the project, researchers can conclude that customer service is an integral part in a business for it to be successful and if it provides good quality service, more customers can be obtained and existing customers retained. Thats what Romans Pizza and Time Beaters (Pvt) Ltd is trying to do and if they keep on serving customers with quality they can gain edge over their competitors. Recommendations Romans pizza should improve the hygienic state of their company since it is not good for the health of the customer. The waitress must pay attention when the customers place orders and also brief about the variety of pizzas available in order to avoid mismatch in the products. Also the time estimated for the pizza to be ready should be taken into consideration because sometimes the time promised to the customers for the pizza to be ready is exceeded. The Romans pizza should not take more time to place the orders and should not make the customers to wait for a long time .

Kretchmars Five Types Of Dualism

Kretchmars Five Types Of Dualism The classical emphasis emerged from one of the most famous Greek philosophers dialogue, Platos Phaedo. Plato believed that the most important things are not the material or physical entities but the eternal Forms. He also stated that the bodies and physical matters are just imperfect replicas of such Forms. Aristotle, one of Platos students did not believe in the Platonic Forms. Aristotle argued that the body is far more important than the mind and the soul (the mind) do not exist. His forms are the property of things and the things existing in those things. This made it easier for Aristotle to explain the body and soul union by saying that the soul is nothing more than form of the body. Due to this reasoning, by Aristotle arguments the soul is something material because it is a property of the body. Aristotle argument and theory led to many interpreters, ancient and modern, to interpret Aristotle theory as materialistic. The more modern version of dualism has their origin and is associated Rene Descartes Meditations. Descartes was known to be a substance dualist. He states that there are two types of substance, the matter which the essential property is spatially extended and the mind which is the essential property that do the thinking. In very recent history, Scott Kretchmar divided Descartes dualism into five kinds. These five kinds are: Substance Value Knowledge Language Behaviour Substance Dualism: Substance is at the heart of the dualistic thinking and practise. Dualists argue that the mind (soul) and the body are two radically different things. The body is seen just like another object, it is like on the same level of a football, water and rocks. When we see the body from this perspective, the body can be used, manipulated, dissected and treated like any other object. Since the body is seen as an object, then the body is just a machine made of joints which move using the levers and force. Like any other physical object the body obey and use the laws of physics. The substance dualists also acknowledge thinking. Thought is not like the matter. Matter has shape, colour and obey laws. Thinking or the mind or the soul does not have colour, size, form or shape and do not observe physics laws. The mind obeys the logic rules and coherence. Substance dualism does acknowledge that the body and mind interact. These dualists also acknowledge that the body affect the mind and vice versa. While the connection between the mind and the body is very difficult to explain, but through scientific experiments and personal experience the body and the mind do affect each other. Value Dualism: Value dualism grounded deep in substance dualism. Value dualists see the human as being the mind and the body. Plato placed the thoughts, perfection and ideas over the body, above the mediocrity and emotions. Plato continued his theoretical argument that the body at its best serve as a compliment to the mind and helping the mind to acquire more intellect and knowledge. At the same time, he stated that at worst the body will hinder the mind from gather more knowledge due to our carnal nature and desire. If this happens, it will be the source of our animal instinct, emotion disturbance and perceptual errors and then peak result will be pain and death. Plato stated that our physical senses may perceive things in a wrong way and therefore our senses will transmit to the mind wrong messages and the knowledge transmitted can be negatively influencing the mind. Value dualists; value the mind over the body, with the body being the source of all evil. But this raise some questions, such as, does all the evil come from the body? Impure thoughts, such as, excessive anger and greed does not disturb the acquisition of knowledge? Is this evil which originated and circulated in the mind without any help from the body? Knowledge Dualism: Knowledge dualism is divided into two categories, the knowing and the knowing how. The knowing is pure knowledge, pure understanding of things. The knowledge of why some things work better than others, why things occur in such a way and order. Knowledge of why we feel better after a good session of training, why our cardiovascular system improves in functionality with regular training. The knowledge of knowing how is purely procedural. This kind of knowledge help people and athletes perform better skills. A great football player can kick the ball with so meticulousness that if he is ask how he did it he wont be able to explain what he did. The player will be at a level of knowledge of kicking the ball that for him it will be hard to explain the complexity of the angle of the foot, the power in the kick and the position of the supporting leg. This happens because it so natural for him to do that and cannot explain why and how. People with this kind of dualism do not really understand what they are doing and this will compromise the value of accomplishments. Behaviour Dualism: Gilbert Ryle in his book The Concept of Mind describes behaviour dualism is a type of value dualism because it climaxes the requirement of the body as a machine and the mind as an operator. This kind of dualism suggests that all actions has a dual process. The process of thinking followed by the process of doing. These dualists beliefs are similar to the valuelists because they believe that since the body is only a machine it cant function on its own. Therefore; since the body is only a machine, it must awaits for commands from the mind. The behavioural dualism point of view is that the mind and the body are in an unbalanced relationship where the body depends totally on the mind. Language Dualism: Language dualism is similar to the behaviour dualism and is considered as a value type dualism. This kind of dualism focuses on symbolism focuses on an image or an action and such action or images stand for something else. According to Ernst Cassirer in his book Philosophy of Symbolic Form (1944), the achievement of using symbols is what makes us human beings. This is also considered as a trademark for human beings and this hallmark distinguishes us from all the other lower life forms. This kind of dualism is divided into two major groups, intellectual and non-intellectual. The intellectual group consists of poems, prose and other writing and spoken form. This group also include any mathematical symbols used in physics and other sciences. Since these are considered intellectual, these factors are at the heart of most of IQ tests, SRT and other intelligence and academic testing. These are used because they are considered as they are thought to show the mind workings at its best. The other group is the non-intellectual. Paintings, music and sports are found under this category. Because these form part of the non-intellectual group, these are given a lesser academic rating and importance.

The Crucible: A Masterpiece of Dramatic Writing Essay -- Essay on The

Ã‚  Ã‚  Ã‚  Ã‚   The Crucible provides us with an example of a masterpiece of dramatic writing. In this play Arthur Miller gives us a stimulating example of the use of a variety of theatrical techniques. His most powerful scenes in "The Crucible" have common characteristics: very effective use of stage actions, long build-ups of suspense that come crashing down in thundering climaxes, intense displays of emotion and an abundance of dramatic irony. These are my three chosen scenes: p46-50: "Tituba........Devil!", p98-100: "She thinks.......Oh God" and p101-105: "You will.....Mr Hale!". Because of the importance of these scenes as key moments in the play Miller makes them dramatically superb so that the "No,sir" by Elizabeth that decides the outcome of dozens of lives and of her own and her husband’s, John Proctor is also the climax of the most effective build-up of suspense in the play. The effectivness of these scenes is also enhanced by powerful characters such as John Pr octor and Danforth who display such intensity in their emotions and actions that the audience can not help but be moved. But most of all, these scenes show Miller’s theatrical qualities so that by the end of each of these scenes we not only understand his message but also find ourself convinced by his arguments . The dramatic impact of a play is enhanced when the audience understands all the different aspects of the main characters. It helps them become more involved and at the same time gives the author the chance to display some dramatic irony. Miller uses stage actions to that end in the first chosen scene of "The Crucible". In this scene Tituba’s inner conflict and Hale’s resolution is clearly expressed through the stage actions. Tituba first denies having seen ... ... power. "The Crucible" is considered by many Miller’s masterpiece, it both displays his dramatic and theatrical qualities in such a way as to make it disturbing and socially relevant. In it one can find his views on society as a whole and on current events such as Mccarthyism which similarily to the medieval Church and justice system searched for individuals who by their ideals and ideas they felt threatened the supremacy of their system. Miller made "The Crucible" the starting point for the audience to reflect on their own society and culture. But at the same time Miller polished his deep philosophical work with superb stage directions, likeable characters and nerve-racking suspense. Role of Women in Mark Twains The Adventures of Huckleberry Finn :: Adventures Huckleberry Huck Finn Essays

Huckleberry Finn – Role of Women Throughout history women have been subject to sexual discrimination based on being the physically weaker gender and thus leading to society's negative view of women, there is no exception to the stigma cast on women in The Adventures of Huckleberry Finn. During the novel every character portraying a woman shows society's view on the role on women. The issue of sexism was never questioned by Mark Twain, which leads to another question--- how can such a powerful novel dealing with such a heated topic like racial prejudices remain totally neutral and bypass altogether sexual inequality? One reason Twain may have overlooked the sexism of the time was because he too gave into society's connotation of women's roles. Olivia Clemens, his wife, was very much like Sally Phelps. She was dependent on her husband and served with no other true purpose in life than to run a house and bear children. But, did Twain look over sexism or support it? He may have had issues with women due to his own marriage. His wife never produced a healthy son, and she was always sickly. The dependent Olivia was even thought to hinder his ability as a writer. So were the roles of women purposely placed in the novel to support his own opinions of women in the home? Miss Watson plays into society's rules and regulations. "Miss Watson, a tolerable slim old maid, with goggles on, had just come to live with her, and took a set at me now, with a spelling book. She worked on me middling hard for about an hour, then the wido made her ease up. I couldn't stood her much longer." (The Adventures of Huckleberry Finn, Twain, page 2) The word spinster came into common use during the early 19th century when the thankless task of spinning cloth had been pushed off to unmarried women as a way to earn their keep in the home (O'Brien, 1973). Miss Watson is the image of everything an old maid stands for. Contemporary use of the word conjures up a mental image of a childless, frumpy, middle-aged woman who is somewhat depressed, and is longing to be like other "normal" women.

How Internet Affects Life Essay

Nowadays, the use of Internet is increasing especially among adolescence or more accurately, students. The Internet issue is discussed by the adults and parents. Most of them are worried that the use of Internet is dangerous to their kids. Some others said that Internet may bring benefits to their children especially to those who will be sitting for an examination. On my opinion, Internet has both benefits and drawbacks. First of all, let me talk about the benefits first. As we know, Internet is mostly used by students. By surfing internet, students can visit various websites to assist their studies. The examples of popular websites are tutortv.com , unicliq.com , and tutor.com.my. They can visit the websites and revise their studies in more exciting way. Some of them are free. Students can visit it anytime they want. The websites also provide useful notes and exercises. At the same time, students can get additional information that they cannot find it in books. For instance, they can go to ‘Google’ or ‘Yahoo’ search engines to search for more ideas to write an essay. In short, Internet provides vast informations and knowledge which is very beneficial for the students. Next, Internet also provides lots of social networks such as Facebook , Twitter, MySpace and many other. Through these social networks, we can add more friends and make new friends. We can also know friends from other country as these social networks are used internationally. Other than adding friends, we can also strengthen our relationship with our friends and family who are staying far away from us using Skype. We can see them in front of our eyes eventhough they are actually far away from us through web camera. Besides, Internet also offers entertainment. We canwatch videos of our favourite artists by just one click through ‘Youtube’ website. We can also watch favourite movies without paying. Plus, there are many artists born from ‘Youtube’. So, fans can know more about the artists from Youtube. Meanwhile, 4shared.com provides tracks, videos and files that can be  downloaded for free! Internet users can enjoy themselves at anytime watching their favourite artists’ performance for free. Internet doen not only offersbenefits for students but also to those who want to gain more money. It also provides business opportunities. As for example, mudah.my gives a wide room for surfers to promote anything they want to sell. Through this, people with no job can gain money and support their lives by doing the online business. However, as I said earlier, Internet also brings bad effects to its users. Firstly, it can encourage cyber crimes. Besides that, students who spend too much time on Internet may neglect their studies and do not finish their homework. This should be avoided as studies are important especially to teenagers. Although Internet can add more friends to our list, yet, it still can develop anti-social behaviour. Not all of the users use Internet to make friends, someof them only play video games or just sit down wayching videos on Youtube. They will only sit and ignore what is happening around them. The worst thing is, they may not realise that there is an earthquake out there! This anti-social behaviour may leads to health problems. The users will just stay at home and sit in front of computer and this will cause them to be lazy couch potatoes. It will also lead to obesity. Next, most students will not attracted to surf knowledgeable websites, but wasting their time on other non-beneficial things. Wasting timeon Internet can cause students to neglect their studies. Not only time is wasted but also money. With the uses of more electricity non-stop, utility bills may increase dramatically. We just not pay for the electric bills but also internet monthly bills. The conclusion is, everything has its own benefits and drawbacks. However, it depends on how we are using it. If we spend more time using it for benefits, we will get positive effects. But if we use it more to non-beneficial things, we will get negative effects. So, it depends on you.

Ethics is a branch of philosophy that judge human beings on wrongs and rights concerned with the nature of value and the standards by which human actions can be judged .The term is also applied to any system or theory of moral values or principles. Accounting is the mechanism that offers information regarding the financial position of the organization or business. This type of information is critical to investors as it provides them with important and detailed information that could turn out to be the determining factor as to their decisions to invest or not to invest in a particular organization. Accounting in business is one of the most important departments. Ethical and professional accounting forms a clear financial image of a business, and allows managers to make informed decisions, keepsinvestors abreast of developments in the business, and keeps the business profitable. (Osanyin, 2008) In accounting, there is the professional ethics that guides the accounting profession. Accountants are expected to adhere to the set ethical standards which are designed to ensure that they behave in a way which is ethical and consistent. For most professional accounting organizations, accountants are certified in order to comply with ethics and they are stripped off their certificates if they fail to abide with ethical codes. Therefore, it is common to find unethical behavior in accounting profession. Some of the forms of unethical behavior in accounting are, Providing erroneous information regarding expenses incurred in business Giving out false information on expenses purposely is unethical. In accounting profession, the accountant should always provide the correct information regarding any expenses as failure to do so make the financial status of the business to be false. This affects the profit and loss reports of the business and consequently affecting the performance of the business in the long run. Exaggerating business revenue In accounting practices, all revenue in the business should be reported correctly as this can hurt investors in the company, the tax payers who may be caught up in governments bail outs and the workers at the company. By showing the correct revenue generated, this reflects the true financial position of the company. Misuse of business funds Accountants access most of the funds in the organization and it is unethical to misuse them. This can lead to the closure of the business and eventually leads to the loss of jobs and investments. Accountants should never misuse business funds and if they use it should be reported in the books of accounts and debited clearly. Some of the reasons why ethics is important in accounting are;- Confidentiality: People need to have confidence in accountants and the services they provide. Failure to do so leads to uncertainty in investors, shareholders and the work force in the organization. If the quality of the accounting is unprofessional this leads to low confidence with the stakeholders of the organization. Professional Competence: Ethics in accounting ensures that the accountants maintain professional knowledge and skills at the level required to ensure that a client or employer receives competent professional service. This is exhibited by acting diligently and in accordance with applicable technical and professional standards when providing professional services. So as to maintain law and regulations governing the accounting profession, accountants should always observe the professional ethics in their profession.

Art Essay

* Art is a term that describes a diverse range of human activities and the products of those activities, but here refers to the visual arts, which cover the creation of images or objects in fields including paintings, sculpture, printmaking, photography, and other visual media. They are two paintings that have been drawn by Dmitry Levitzky in 1773 and by Millais in 1871. The first portrait by Dmitry levitzky is called Nelidova, Ekaterina Ivanovna who she is the daughter of Lieutenant Ivan Dmitrievich Nelidov. She was raised in the Smolny Institute for Young Ladies and was noticed there by Empress Catherine II, who made her a maid of honor to the Grand Duchess Maria Feodorovna, later Empress, whose husband Emperor Pavel I. She was sincerely attached to him, although their relations were never intimate. She was able to influence Pavel I, preventing some of his unwise decisions and tantrums. She was also a close friend of the Empress Maria Feodorovna. The second portrait by John Everett Millais is called The Martyr of Solway the â€Å"Margaret† depicted by Millais was Margaret Wilson, who was born in 1667 in Glenvernoch in Wigtownshire. She was a young and devout Presbyterian who was a member of the Covenanters, a Scottish Presbyterian movement of the 17th century in Scotland who signed the National Covenant in 1638 to confirm their opposition to the interference by the Stuart kings in the affairs of the Presbyterian Church of Scotland. The Stuart kings embraced the belief of the Divine Right of the Monarch. However, not only did they believe that God wished them to be the infallible rulers of their kingdom – they also believed that they were the spiritual heads of the Church of Scotland. This latter belief was anathema to the Scots. Their belief was quite simple – no man, not even a king, could be spiritual head of their church. The following piece will demonstrate the differences and similarities between the two images in a compare and a contrast manner. Analyze the fundamental differences. Point out the major mutual points.

Lower the U.S. Drinking Age

2-27-12 I. Introduction: †¢ All around the world many people drink alcohol for many different Occasions. There are drinks at parties, bars, clubs and even your home. You can find alcohol just about everywhere in the United States. Around the world there are many different age requirements in order to drink or buy alcohol. The majority of countries around the world have a set age minimum of eighteen years of age. So why is our drinking age 21? †¢ Why is this important to us? We are all college students and everybody knows that there is underage drinking one way or another. Professor Ruth C. Engs from Indiana University states â€Å"The legal drinking age should be lowered to about 18 or 19 and young adults allowed to drink in controlled environments such as restaurants, taverns, pubs and official school and university functions. † †¢ I believe that the legal drinking age in the United States should be lowered to the ages of 18 or 19. The reason it should be lower ed is because college students will drink at least once during their first year of college. Legally, at the age of eighteen we are granted the rights of adults. And finally, by forbidding teens to not drink that forces them to drink in unsafe places. II. College students drink! †¢ College students will always drink! According to alcohol101. com 72% of all college students drink alcohol. 69% of the total 72% are underage drinkers. †¢ If the legal drinking age was lowered to 18 then drinking in college will not be as big as it is now. It would still occur but not as much as it does now. †¢ By lowering the drinking age, college students will be able to drink in safer places such as bars or clubs, instead of house parties or other places. Now that I’ve talked about college students drinking I will now move onto how at the age of 18 the U. S. calls us â€Å"adults†. III. Considered â€Å"adults† †¢ At the age of 18 in the United States we are consid ered â€Å"adults† and obtain all the rights and responsibilities of being adults. At this age we can now vote, sign up for the armed forces, and buy cigarettes. However we cannot buy or consume alcohol legally until 3 years later. †¢ If we are already considered as adults at the age of 18 then why can we not lower the drinking age?Now that I have talked about being adults but not being able to buy alcohol at the age of 18, I’m going to talk about now how drinking at unsafe environments is harmful. IV. Unsafe Drinking Environments †¢ Because the legal drinking age is 21, that forces college students, mainly freshman, to drink at house parties where they do not know what they are drinking at times. †¢ Drinking at house parties seems fun, however it could go bad in many ways. Since freshman cannot buy alcohol they resort to free alcohol at parties, which could be very dangerous because they will be unaware of any thing that could be put inside their drink. Setting the drinking age to 18 would allow these college students to purchase their own drinks and they will for sure know what they bought and it would be closed therefore letting them know it is safe to consume. V. Conclusion †¢ To recap on my speech; the drinking age should be lowered to the age of 18 in the United States. Not only is that the most popular age to drink around the world it is a very reasonable age. By changing the drinking age to 18 then we can really be considered as adults and will be responsible for our own actions.

Greg Beato: Amusing Ourselves to Depth

GREG BEATO: Amusing Ourselves to Depth 1. Tim Keck started The Onion because â€Å"he wanted to create a compelling way to deliver advertising to his fellow students†. â€Å"Part of the first issue’s front page was devoted to a story about a monster running amok at a local lake; the rest was reserved for beer and pizza coupons. † (389) This shows that the newspaper’s direction towards â€Å"fake news† and advertisement. 2.The Onion is one successful newspaper because it prints 710,000 copies of each weekly edition, 6,000 more than the Denver post; have 3000 local advertisers; attract 2 million online readers a week and boast a 60% increase in their print circulation. (389-390) 3. Beato choose the title â€Å"Amusing Ourselves to Depth† because it warns the fate that would befall us if public discourse were allowed to become substantially more entertaining (390), which is the opposite to what The Onion is doing. This suggests Beato is against this idea, and supports The Onion, that entertainment in news is good. 4.Beato mentions â€Å"America’s most informed citizens simply prefer comedy over the stentorian drivel the network anchormannequins dispense,† (390) to argue against Neil Postman’s notion. 5. The Onion focused on expressing a worldview of any kind and delights in crapping on pieties and regularly publishes stories guaranteed to upset someone by being completely honest. 6. Beato is not suggesting that fake news is better than â€Å"real† news but implying that by being honest, expressing a worldview of any kind and not afraid of offending people with a pinch of entertainment is better way to convey news.

What Form Will Domestic Terrorism Take in the Future in the United Research Paper

What Form Will Domestic Terrorism Take in the Future in the United States - Research Paper Example This was a form of domestic terrorism since the perpetrators of the bombing were US citizens. This paper discusses the form that domestic tourism is likely to take in future in the US. It presents a comparison of the right wing comprised of white extremists, left wing, animal and eco terrorists and the influx of radical Islam in to the US. Right vs Left Wing Movements Both right and left wing movements share revolutionary ideologies. According to FBI (2009), the militia movement remains the most recent anti-government right wing movement. These extremist groups have been persistent in the US since the bombing of the federal building in Oklahoma. The extremists comprise people who share anti-government ideologies. They are opposed to taxation by the federal government as well as the regulations imposed on economic activities. The militias also resist the federal government’s involvement in international activities as well as equality with regards to racial and religious minorit ies. In other words, they can be described as white supremacists and anti-government groups. The Ku Klux Klan is one of the renowned white supremacist groups. FBI further notes that right wing terrorist groups such as the Skinheads and the neo-nazis are significant security threats to the US. They engage in activities such as bombing as well as indiscriminate shooting in cities (Mullins and Young, 2010). Bjelopera (2011) argues that leaders of these groups promote the advancement of highly structured conspiracy theories making members to believe and behave in ways that make the group undesirable to the law abiding citizens. Some of them advocate for the removal of the term ‘illegal fire arms’ depicting that they would wish that they be allowed to own weapons. Considering their extremist ideologies and the fact that some have paramilitary organizational structures, the federal government has made concerted efforts to quell any terrorist plans that may cause harm to the p ublic through arresting any person possessing illegal arms. The more the federal government exerts pressure on these extremist groups, the greater their efforts to make their ideologies acknowledgeable among susceptible citizens. According to Lerner (2003), right wing extremists make efforts to affirm the need for pursuant of their goals. Their strategy is focused on indoctrination of the public with false philosophies against the government. Left wing domestic terrorism dates back to the late 19th century in the US. It was associated with anarchist groups who were against capitalism. These groups were backed by revolutionary immigrants from Eastern Europe (FBI 2009). Even though left wing terrorism began to decline in the mid 1980s, they left a trail of destruction, worst of all the killing of President William McKinley in 1901 and several bombings perpetrated on US industrialists and capitalists. The most recent left wing groups include; Weather Underground, SLA and the FALN among others who used strategies that instilled fear among the public such as widespread kidnapping and bombing of populous places such as Chicago’s Haymarket. These were among the strategies that the left wing terrorists used to attract attention to their ideologies. However, according to FBI, the only active left wing extremist group is the Puerto Rican separatist movement (Mullins and Young, 2010). Animal and Eco Terrorists Animal and eco terrorists are groups that focus on special interests such as

Implementation of the Saudi Mortgage Law Developing an Effective Research Paper - 3

Implementation of the Saudi Mortgage Law Developing an Effective Mortgage - Research Paper Example The provisions of Saudi Arabia ‘real estate mortgage law’, which was signed into law on July 2, 2012, offer different ways through which the law will be implemented. First, under the ‘Enforcement’ Law, the law has provided that judges should hear and enforce mortgage disputes and insolvency actions (Delloite, 2). In this respect, the law has allowed the courts to decide on the order of the repayment of the mortgages, in a way that would guarantee swift repayments. Under the ‘Real Estate Finance’ Law of the Saudi Mortgage Laws, an elaborate architecture and framework for the authorization and licensing of banks and other non-banking companies to offer mortgage facilities has been established. Thus, according to this section of the law, banks will be allowed to own real estate’s for the purpose of facilitating mortgage lending (Khan, 2). Additionally, the government will facilitate the banks and companies offering the mortgage services, through publicizing real estate market activities, while at the same time granting the companies and the banks an access to the notary registers and the courts (Delloite, 2). This s ection of the law has also provided that a credit risk must be undertaken on the borrowers, through the aid of the authorized and available credit bureaus, to ensure the creditworthiness of all borrowers. Further, the Saudi Mortgage Law includes a section under the ‘Registered Real Estate Mortgage’ Law, which provides for the procedures of the registration of mortgages (Khan, 7).
